Partner

Background

Emre Kurt is a partner in GEMS Schindhelm's Ankara Office.

After graduating from Marmara University Faculty of Law in 2002, he completed his legal internship in Istanbul. He has successfully completed his LL.M. at Queen Mary University of London in 2007.

He has a book called Trademark Law in Practice, his articles published in many journals, and is the editor of one of Turkey's most visited law blogs.

He has been a member of the Ankara Bar Association since 2010.

Emre Kurt's practice focuses on intellectual property law and commercial disputes. He advises domestic and foreign companies on the protection, commercialisation and enforcement of their intellectual property rights and represents his clients in administrative and court proceedings.

A significant part of his work consists of developing intellectual property strategies aligned with his clients' business models and commercial objectives. He provides strategic advice along the entire chain, from which rights are to be secured in which countries and through which instruments, to the structuring and management of IP portfolios, the licensing and commercialisation of rights and their protection and enforcement in the event of infringement. His registration as a patent and trademark attorney with the Turkish Patent and Trademark Office (TÜRKPATENT) and his litigation practice in IP disputes allow the filing and protection strategy to be developed from the outset together with the strategy for potential disputes and enforcement.

Trademark law is one of the core areas of his practice. He handles the creation and protection of the Turkish trademark portfolios of domestic and foreign companies, application, opposition and re-examination proceedings before TÜRKPATENT and international trademark matters under the Madrid System. Before the intellectual and industrial property courts he represents clients in trademark infringement, invalidity, annulment of TÜRKPATENT decisions and unfair competition actions, and handles preliminary injunctions, customs measures and anti-counterfeiting proceedings.

In patent, utility model and design law he advises on the acquisition, protection and commercialisation of rights and conducts infringement and invalidity disputes in these fields. In addition to the strategic management of companies' IP portfolios, he drafts licence, franchise, technology transfer and IP assignment agreements and represents his clients in disputes arising from such agreements.

His copyright practice covers in particular the protection of works in the digital environment, software and databases, online content infringements, the protection of rights on internet and social media platforms and the liability of platforms and service providers. In copyright infringement cases he advises and represents rights holders from content removal and access-blocking through to preliminary injunctions and main proceedings.

International and cross-border disputes form a major part of Emre Kurt's practice. He represents companies and rights holders from different countries in Turkey-related intellectual property and commercial disputes and works in coordination with Schindhelm's international network, foreign law firms and local advisers in matters involving several jurisdictions. He focuses in particular on disputes arising from international IP portfolios, disputes under licence and other commercial agreements, and the protection and enforcement in Turkey of the rights of foreign rights holders.

As part of his practice in Ankara he handles proceedings before TÜRKPATENT and other central administrative authorities as well as disputes before the Ankara Civil Courts for Intellectual and Industrial Property Rights. Conducting the administrative proceedings before TÜRKPATENT together with the ensuing court proceedings enables him to offer clients integrated representation from the development of the IP strategy through registration and protection to the dispute stage.

Emre Kurt complements his practice with academic work and comparative legal research, focusing in particular on the interaction between Turkish and European Union intellectual property law. He holds an LL.M. in Corporate and Commercial Law from Queen Mary University of London. His book on trademark law, Uygulamalı Marka Hukuku (AB İçtihatları Işığında) (Trademark Law in Practice in the Light of EU Case Law), is in its third edition. His comparative study of the administrative revocation procedure for non-use under Turkish trademark law and European Union law was published in 2026 in the Journal of Intellectual Property Law & Practice (JIPLP) published by Oxford University Press; his further work on intellectual property, internet and technology law has appeared in national and international legal publications.

Registered as a Registered Foreign Lawyer (RFL) with the Solicitors Regulation Authority (SRA) in England and Wales and authorised to practise in that capacity, Emre Kurt advises individual and corporate clients in the United Kingdom. He works on company formation and corporate structuring in England, Corporate Immigration including Self-Sponsorship, Global Talent and Innovator Talent routes, and personal and corporate investment and real estate transactions, conducting his clients' legal processes in coordination with English solicitors and other professional advisers. In matters involving several jurisdictions he coordinates the cross-border processes together with lawyers in the relevant countries.
