Companies continuously invest in the acquisition, development and use of know-how. This results in significant competitive advantages. Information thus becomes the currency of the knowledge-based society.

So far, the protection of trade secrets has been patchy. This is changing with the latest amendment to the Unfair Competition Act (UWG). It not only eliminates legal protection deficits, but for the first time also defines the concept of trade secrets. According to this definition, this involves secret technological and/or commercial information of economic value that is subject to appropriate confidentiality measures.

Thus the legislator once again imposes challenging compliance obligations on entrepreneurs. Without appropriate confidentiality measures, no trade secret worth protecting will arise from the outset, even in the case of secret and valuable information.
